General Conditions of Sale
These General Conditions of Sale (the "GTC") govern the relationship between the company Wbeauty and any adult physical person placing an order on the Site. They apply to sales of products concluded between the Company and the customer on the Site.

1. Customers
The products offered on the Site are strictly reserved for "physical persons" of eighteen (18) years of age, with full legal capacity to order on the Site, contracting for their private needs and having a delivery and billing address in France.
In accordance with the provisions of article L.3342-1 of the Public Health Code, the Company reserves the right to ask the Customer to justify his identity.

2. Acceptance of the general conditions of sale
Any order placed on the site implies prior and unreserved acceptance of these GTC. The CGV applicable to the order are those in force on the day of validation of his order on the Site. However, the General Terms and Conditions are subject to modifications and updates. It is up to the Customer to read the CGV with each new order he places.
The customer has the option of printing these GTCS or saving them on his computer. It is specified that they are available to the Client whether or not the latter places an order on the Site

3. Products
3.1. Product description
Each product offered on the Site is the subject of a description which presents the essential characteristics of the selected product. The photographs or graphic representations used to illustrate the products, whether standard or personalized, have no contractual character.
The Company must comply with the applicable French standards relating to the products sold. It may have to change its products and packaging in order to comply with these standards, in particular by incorporating logos and notices made mandatory.
3.2. Product availability
The product offers are valid as long as they are visible on the Site and within the limit of available stocks. In case of unavailability of a product after placing the Customer's order, our Company undertakes to inform it as soon as possible by e-mail and to offer, at the Customer's choice, either the maintenance of his order with a postponement of delivery, i.e. the cancellation of the entire order and its refund, as soon as possible and at the latest within 14 days of the request for reimbursement by the Customer.

4. Order
4.1. Customer account creation

Welcome gift: two conditions must be met.

Condition 1:

Coupon to be returned imperatively before the deadline, you have a period of 7 days to return the coupon, postmark being taken. The conditions are also listed on your coupon.

If a problem during the sending of the coupon is found, a proof of sending by post, always with this stamp, will prevail and will allow to validate or not the first condition.

Condition 2:

To receive your welcome gift, you must place an order worth at least € 200 excluding shipping costs "card paid without influencer code". This order must be made within one month from the purchase of the privilege card. The purchase amount of € 200 can be made in several orders.

If you have received an influencer code which has been given to you then you must place an order worth at least € 250 excluding shipping costs. This order must be made within one month from the purchase of the privilege card. The purchase amount of € 250 can be made in several orders.

We would like to point out that the gift selected during your purchase of the Privilege Card will be sent to you within 2 weeks once the purchase amount for condition 2 above has been completed.

Please note, any product added and ordered during the purchase of the Privilege Card will not be taken into account in the calculation of the purchase amount to reach in order to benefit from the welcome gift.

We would also like to point out that a 25% reduction in our Privilege Cards, for the purchase of products from the WBeauty site, will not be taken into account when you place your first order with the Privilege Card and no retroactive effect will be possible.

The Customer must create an account on the Site when placing their first order and, to this end, must fill out the form available to them. This form contains information that is "compulsory" because it is necessary for the identification of the Customer and the delivery of his order (name, first name, delivery and billing address, telephone number, email address, password, etc.).
It is specified that the password chosen by the Customer is personal and confidential. It will allow him to identify himself later on the Site. In the event of a forgotten password, the Customer may request a new password by clicking on the "Forgotten password" tab in the "Log in" section.
The information thus communicated must be complete, exact and up to date. The Company may, if necessary, ask the Customer for confirmation (by any means) of the information it provides and of its identity.
Access to the site, as well as orders placed there are subject to these general conditions of sale. They specify the terms of online sales and deliveries of products ordered on this site and inform you of your rights and obligations in connection with the sale of these products.
The general conditions of sale (CGV) apply to all merchant goods and services (tangible and intangible), as well as to codes, reduction coupons and gift vouchers offered on the site, without limitation or reservation.

4.2. The order
To order a product on the Site, the Customer must follow the following steps:
1. The Customer is asked to identify himself to register an order. If he already has a customer account, he enters his email address and password. If he does not have a customer account, he creates a customer account.
2. He then selects the products he wishes to order by adding them to the basket by clicking on "Add to basket".
3. And finally he accesses his basket by clicking on the basket icon then on "View my basket".
4. On the "Your basket" page, the Customer can:
o Add or delete items to your cart
o Enter your PROMO code (promotional code) if you have one
o See the summary of his basket, including the promotions applied
5. Once on his basket, to go to the next step, the Customer must first accept these General Conditions of Sale made available to him via a hypertext link by clicking the check box provided for this purpose and then click on "Fill in" my delivery address and confirm my order
6. The Customer is automatically sent to the "Delivery method" page so that he can choose his address and delivery method.
7. To go to the next step, the Customer must then click on "Confirm my order and proceed to payment" which returns him to the "Payment method" page on which the Customer selects his payment method.
8. To definitively confirm his order and pay, the Customer clicks on "Confirm and pay". The Customer is then redirected to the payment provider's transaction platform where he indicates his bank information and confirms his payment.
9. Once the Customer has validated and paid for his order, (i) he is automatically redirected to a page on the Site on which the Company confirms his order, (ii) in parallel, the Customer receives an email from the Company acknowledging receipt of his order and communicating to him an order number as well as a summary of his order.
10. The Customer can follow the steps of processing and shipping his order at any time in his Customer area "My Account".
11. Our Company reserves the right to refuse any order or any delivery in the event of (i) refusal to authorize payment by the banking organization or (ii) total or partial non-payment of a previous order by the Customer.

5. Prices and payment terms
5.1. Price
The prices are those indicated on the Site on the date of the order. They are indicated in Euros and all taxes included. They take into account the value added tax applicable on the day of the order and include any applicable excise duties. They do not include delivery charges.

5.2. Billing
A detailed invoice will be issued for each order and sent to the Customer by e-mail at the same time as the shipping confirmation of the order.

5.3. Payment terms
Bank Card, Visa Card, MasterCard.
The Customer must be the holder of the card used. The Customer will then be automatically redirected to the transaction platform of the payment service provider. The banking information is entered via a secure server to guarantee the security and confidentiality of the information provided by the Customer during the banking transaction
Whatever the mode of payment chosen, the Company reserves the right to refuse any order or any delivery in the event of refusal of authorization of payment by the banking organization or (ii) non-payment, total or partial, of a previous order by the Customer.

6. Delivery
6.1. Delivery method, prices and deadlines
The products offered for sale on the Site are developed and marketed in accordance with the French standards in force and cannot, as such, be the subject of a delivery elsewhere than on the French national metropolitan territory (Corsica included).
Products are delivered via La Poste services
The delivery costs vary depending on the delivery method selected by the Customer:

Delivery to the address of your choice between 3 and 7 working days.
In case of absence, it will be made available to you at the post office to which you are attached. You have 10 working days from the arrival of your package at the post office to collect it. After this time, it will be returned to sender.
Delivery charges may also be offered as part of a promo code.
The products are delivered within a maximum of 8 working days from the day the payment has been made.
Delivery times (service provider)…. indicated in the description above are indicative and are applicable from the delivery of the package to the Post Office. You will be informed by email of the shipment of your package.
To track your package, go to the colissimo.fr site and enter your tracking number provided by email when your order is shipped.
Delivery times are counted in working days (Monday to Saturday excluding holidays).
In order for the aforementioned delivery times to be respected, the Customer must ensure that he has communicated exact and complete information concerning the delivery address (such as, in particular: street, building, staircase number, access codes , names and / or intercom numbers, etc.) and telephone number. Inaccurate information may result in additional delivery times, or even re-shipment.
In the event of a delay in delivery of more than seven (7) days, the Customer must inform the Consumer Service of the Company, which will then carry out the necessary investigations and keep the Customer informed. The Company and the Client will then make their best efforts to promote an amicable solution to resolve the situation.

6.2. Risk and ownership transfer
During transport, the risks of destruction, loss or damage to the product (s) are borne by the Company (without prejudice to any recourse that the latter may have against the transporter responsible for making the delivery).
The transfer of risks and ownership of the Products is carried out on the date of delivery of the Products to the delivery address indicated by the Customer. Delivery means delivery of the order in the hands of the Customer or his agent to the address indicated on the order form.

6.3. Verification of the order upon receipt
The Customer is required to check on delivery the condition and conformity of the products delivered and must, if necessary, express any reservations on the delivery slip. In the presence of an apparent anomaly (in particular damaged, open package, traces of liquid, etc.), the Customer is invited not to open the package and to leave it with the carrier or service provider responsible for delivering the package.


7. Right to retract

7.1 You have a period of 14 days to change your mind in case of purchase by internet or by phone. It's the right to retract. If you exercise this right, the seller must reimburse you for the goods or services ordered. Certain contracts are however not affected.

Excluded contracts

The right of withdrawal does not apply to the following purchases:

digital content provided on an intangible medium and contract for subscription to these services whose execution has started with your agreement and for which you have waived your right of withdrawal (example: a downloaded film)

7.2. Return
Except for the products must be returned by the Customer, at the latest within the period of fourteen (14) days from the notification of the exercise of its right of withdrawal, to the following address: Wbeauté, 117 bis rue Montgolfier 59100 ROUBAIX and must be accompanied by the return slip communicated by Wbeauté.
Products must not be returned, opened or damaged, in their original packaging. If the original packaging has not been kept, the Customer must, taking into account the nature of the products, pack them with the greatest care, and this in order to avoid any breakage. Returned products travel at the Customer's expense and risk. Any damaged product will not be returned or refunded.

7.3. Refund
The Customer will be refunded of the sums paid during the order, including delivery costs, as soon as possible and at the latest within fourteen (14) days following the notification by the Customer of his right of withdrawal, this period may be extended to the date of receipt of the returned products or proof of shipment of these products; the date chosen being that of the first of these facts.
The refund will be made by the same means of payment as that used by the Customer for the payment of his order, unless the Customer agrees on another means of payment. The Company undertakes that the refund will not incur any costs. to the customer.

8. In case of non-conforming, damaged or defective product.
Apart from cases of withdrawal (article 7), in the event of a non-conforming Product (error in reference, quantity, etc.) and / or damaged and / or defective, the Customer is invited to contact, within 72 hours of receipt of the order, with the Consumer Service of the Company; the Customer may also request from the consumer service that the product be replaced within the same period.

9. Liability - force majeure
The contractual obligations of the Company will be automatically suspended and its liability released in the event of an event of force majeure (as this term is defined by article 1218 of the Civil Code and by case law) likely to prevent production or delivery of the Order. In addition, the Company cannot be held responsible for a link interruption, a server failure, electrical or other problems related to the Internet computer network. Finally, the Company's responsibility cannot be engaged in the event that the products sold are stored or consumed under abnormal conditions or incompatible with their nature.

10. Legal guarantees
The Customer benefits from the legal guarantee of conformity referred to in the provisions of articles L. 217-4 and following of the Consumer Code (extracts below). As such, the Company undertakes to deliver compliant products and to respond to any lack of conformity existing during delivery.
"The seller delivers goods that conform to the contract and is liable for any lack of conformity existing when they are delivered. He is also responsible for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter has been charged to him by the contract or has been carried out under his responsibility. "(Art.L217-4)
« The products comply with the contract:
1° If it is suitable for the use normally expected of a similar good and, if applicable :
– if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model ;
– if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling ;
2° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special purpose sought by the buyer, brought to the attention of the seller and which the latter has accepted. "(Art.L217-5)
« The action resulting from the lack of conformity lapses two years after delivery of products. » (Art.L217-12)
The Client also benefits from the legal guarantee against hidden defects referred to in the provisions of articles 1641 and following of the Civil Code (extracts below).
« The seller is bound by the guarantee for hidden defects in the thing sold which makes it unfit for the use for which it is intended, or which reduces such use so much that the buyer would not have acquired it, or would have given a lower price, if he had known them. » (Art. 1641)

« The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect. » (Art. 1648. Alinéa 1er)

11. Retention
The Company cannot be held responsible for defects found on the products and resulting from poor storage of the products by the Customer.

12. No waiver
The fact that the Company does not avail itself at any given time of any of the provisions of the CGV cannot be interpreted as being a waiver for the Company to take advantage of it later.

13. Intellectual property
All the elements (texts, logos, images, graphic or sound elements, software, icons, layout, database,) contained in and presented on the Site are protected by intellectual property law. These elements remain the exclusive property of WBeauté. As such, the Customer may not carry out any reproduction, representation, adaptation, translation and / or partial or full transformation, or transfer to another website of any element composing the Site. Failure to comply with this prohibition may constitute an act of counterfeiting engaging the civil and criminal liability of its author. Finally, the Company recalls that any creation of a hypertext link to one of the pages of the Site is subject to the express, prior and written agreement of the Company.

14. Evidence, retention and archiving of transactions
The Company implements all means to ensure the confidentiality and security of the data transmitted on the web. The computerized registers, kept in the Company's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments made. In accordance with applicable laws and regulations, the archiving of purchase orders and invoices is carried out on a reliable and durable medium, in accordance with legal provisions. The Customer can make the request at any time via the consumer service for the entire legal retention period.

15. Language of the CGV
The Terms and Conditions were originally drawn up in French and there is no translation into another language. If a translation of the CGV should be made available to one or more Customers, only the French version will prevail in the event of a dispute, in particular in the event of mediation (or any other alternative method of dispute resolution) or before a court.

16. Disputes - applicable law
These CGV are subject to French law.
In the event of a dispute, subject to having previously entered the Consumer Service and in accordance with the provisions of article L. 612-1 of the Consumer Code, the Customer may have recourse to a conventional mediation procedure.

In the absence of an amicable agreement between the parties, any dispute resulting from the formation, interpretation or execution of these General Conditions of Sale or any order, will be subject to the jurisdiction of the French courts.
